  1. Not convinced that Kagan was a voice of reason or that the ‘conservative’ wing’ of SCOTUS flippantly tossed restraint aside…the ‘experts’ cited before, during and after arguments contradicted themselves and reversed themselves many times.

    Where was the settled science on this that the author so casually and blindly believes existed from the beginning to the present?

  2. The free exercise of whatever purports to be be a religion shouldn’t be a big problem. The minimum standard is the natural law. This would preclude things such as cannibalism, human sacrifice, polygamy, FGM, suttee etc. The maximum – and ideal – standard would be if the Catholic Church was the established one. In that case, one could outlaw public services of other “religions.”
